TERMS AND CONDITIONS OF USING THE INTERNET SERVICE AT CINI.COM.PL AND CINI.MOBI

TERMS AND CONDITIONS
I. Definitions
Used in this Terms and Conditions terms mean:
1. The Client – natural or legal person, entity or body, to which the specific provisions give the legal capacity and which places an Order through the internet service/ online shop;
2. Civil Code – Polish law of the 23rd of April 1964. (Dz. U. Nr 16, poz. 93 ze zm.);
3. Terms and Conditions – this document, regarding the supply of services electronically through the internet service/ online shop, that is owned by CINI SP. Z O.O.;
4. The Online shop (Shop) – the internet service, accessible at cini.com.pl [cini.mobi], through which the Client can place Orders;
5. Goods – products, presented in the internet service/online shop;
6. The contract of sale – the contract of sale of the Goods as understood in the Civil Code, concluded between CINI SP. Z O.O. and the Client, using the internet service/ online shop;
7. The Act of special terms of consumer sales – The Polish law of 27th July 2002 about the special terms of consumer sales and the change of the Civil Code (Dz. U. Nr 141, poz. 1176 ze zm.);
8. The Act on electronic services – The Polish act of the 18th of July (Dz. U. Nr 144, poz. 1204 ze zm.);
9. The Order – declaration of will of the Client, leading to the conclusion of the contract of sale, specifying the type and quantity of the Goods.
II. General regulations
2.1. These Terms and Conditions specify the rules of using the online shop, available at cini.com.pl [cini.mobi]
2.2. These Terms and conditions are the document, which is mentioned in article 8 of the Act on electronic services.
2.3. The Service/Shop, functioning at the address cini.com.pl [cini.mobi] is being managed by CINI SP. Z O.O.
2.4. These Terms and Conditions specify particularly:
a) rules of registering and using the account at the online shop;
b) Terms and conditions of electronical booking of the products at the online shop;
c) terms and conditions of placing Orders electronically at the online shop;
d) rules of concluding the contract of sale using the service provided through the Shop.
2.5. Using the Shop is possible if the IT system used by the client meets at least the following system requirements:
a) Internet Explorer, version 10 or newer, with the needed apps turned on, such as Java, MotoTools, Cookies
b) Mozilla Firefox, Google Chrome or Edge with the needed apps, such as Java, MotoTools, Cookies,
c) Screen resolution at least 1024x768.
2.6. To use the Online Shop the Client should by his own means get access to the computer or other device connected to the Internet.
2.7. Clients can get access to these Terms and Conditions at any time through the link on the main site at the cini.com.pl [cini.mobi], download it and print it.
2.8. The information on the Goods, given on the website, particularly their descriptions, technical data and the prices is the invitation to concluding the contract of sale, as understood in article 71 of the Civil Code.
III. Rules of using the Online Shop
3.1. To use the Online Shop, the Client should be registered.
3.2. To register, the Client has to fill and accept the registration form on the website.
3.3. To finish the registration, the Client has to accept the Terms and Conditions and provide the personal information which is marked as mandatory.
3.4. CINI SP. Z O.O. can deprive the client of the right to use the Online Shop, as well as limit his access to all or part of the materials at the Online Shop, with immediate effect, in the event of violation of the Terms and Conditions, particularly if the Client:
a) provided untrue, not precise or violating the rights of other persons information during the registration,
b) has violated personal rights of other persons through the Online Shop, particularly personal rights of other Clients of the Shop.
c) has behaved in a way, which would be seen by CINI SP. Z O.O. as inconsistent with the current law or general rules of using the Internet or as detrimental to CINI SP. Z O.O.’s good name.
3.5. The Person, who has been devoid of the right to use the Shop, cannot register again without CINI SP. Z O.O. agreeing to this.
3.6. To assure safety of the communication and data, in relation to provided through the site services, the Online Shop undertakes the technical and organizational action appropriate to the level of danger to the provided services, particularly the means to prevent acquiring and modifying personal data, send through the Internet by unauthorized persons.
3.7. The Client is obliged to:
a) not providing and not forwarding any content forbidden by law, for example the content propagating violence, defamatory content or content violating personal rights and other rights of other persons.
b) using the Online Shop in a way that is not disturbing to its functioning, especially by using the particular software or devices,
c) not sending or otherwise placing the unwanted trade information (spam),
d) Using the Online Shop in a way that is not disturbing to other Clients and/or to CINI SP. Z O.O.,
e) using all content, found on the website only for personal use.
f) using the Online Shop in accordance with the Polish law, provisions of these Terms and Conditions and the general rules of using the Internet.
IV. The procedure for concluding the contract of sale
4.1. To conclude the contract of sale the Client should get onto the website cini.com.pl, choose goods and the desired colours.

4.3. In the message the following information should be included:
- The type of the product,
- chosen colour,
- chosen power of the heater and the type of the cable (straight or coiled),
- invoice data,
- delivery address,
- chosen form of delivery
4.4. After sending the above mentioned message, the Client will receive an e-mail confirming the order and specifying the lead time, as well as the proforma invoice.
4.5. Sending the Order shall constitute accepting the Terms and Conditions by the Client.
4.6. Sending the order shall constitute a declaration of intention to conclude the contract of sale with CINI SP. z o.o. in accordance to the text of the Terms and Conditions.
4.7. The contract is treated as concluded the moment the Client receives an e-mail with the proforma invoice, mentioned in the article 4.4 of these Terms and Conditions.
4.8. The contract is concluded in Polish or English language. The text of the contract is written in accordance to the Terms and Conditions.
V. Delivery
5.1. The delivery method is chosen by the Client. The following are available: collecting the goods at the main office of CINI Sp. z o.o., delivery by an express courier company or delivery by postal consignment.
5.2. The cost of delivery depends on the quantity of ordered goods and the delivery address.
5.3. CINI Sp. z o.o. offers free shipment for Orders of at least 15 pieces to Poland.
5.4. The minimum Order to other countries for free shipment is determined for each country individually.
5.5. The delivery cost is determined individually and depends on the weight of the package and chosen method of delivery. The information about the delivery cost will be send immediately after getting the Order from the Client.
5.6. For Orders made to Poland, the lead time is 2 working days after receiving by CINI SP. Z O.O. the payment.
5.7. The lead time for Orders made outside of the Republic of Poland, the lead time is up to 21 working days after CINI SP Z O.O. receives the payment.
5.8. CINI SP. Z O.O. reserves the right to prolong the delivery time to Poland to 21 working days in case the ordered Goods are not on stock at the moment of receiving the Order. About such prolonged lead time CINI SP. Z O.O. shall inform the Client immediately via e-mail.
5.9. Clients can get access to these Terms and Conditions at any time through the link on the main site of cini.com.pl, download it and print it.
VI. Prices and methods of payment
6.1. Prices of the Goods are in PLN or euro, VAT not included.
6.2. Client can make a payment:
a) by money transfer to the bank account,
b) cash at the CINI office in Czeladź,
c) cash on delivery.
VII. The right of withdrawal
7.1. The Client, who is a consumer within the meaning of Article 22 of Civil Code, can – by virtue of the legislation – withdraw from the contract od sale, concluded at distance, without giving a reason, by making an appropriate statement in writing within 10 days and sending it to the address

7.2. The time limit of 10 days is counted from the delivery day of the Goods.
7.3. The right of withdrawal is excluded if:
- CINI SP. Z O.O. has started – with the consent of the Client – providing the service before the deadline of 10 days since the contract of sales has been concluded;
7.4. In case of withdrawal from the contract concluded at distance, the contract is deemed not to have been concluded. Everything, that was exchanged, is returned in the unchanged state, unless the change is necessary within the usual management. Everything should be returned immediately and not later than within 14 days of the withdrawal. Bought Goods shall be returned to the following address:

7.5. The Goods, returned by the Client shall be packed in the appropriate way, securing the safety of the package during transport.
7.6. The Client shall pay for the cost of the transport.
7.8. Only the cost of Goods is returned, based on the credit note.
VIII. Complaints regarding the Goods
8.1. CINI SP. Z O.O. as a seller is responsible for inconsistences between the contract of sales and the Goods, bought by the Client, within the scope of the Act on specific terms of consumer sales.
8.2. Complaints, that are the result of Client’s rights violation, should be send to the address:Адрес электронной почты защищен от спам-ботов. Z O.O. is obliged to deal with each complaint within 14 working days, and if that wouldn’t be possible, to inform the Client immediately when the complaint shall be dealt with.
8.3. CINI SP. Z O.O. is the manufacturer of the Goods. The manufacturer is a responsible party when it comes to the warranty for the sold Goods according to the terms and the time indicated in the guarantee certificate.
8.4. The warranty period for all CINI SP. Z O.O. products is 24 months.
IX. Complaints regarding electronically supplied services
9.1. CINI SP. Z O.O. acts to assure the full functionality of the Shop within the scope of the current technical knowledge and is obliged to rem
ove, as soon as possible, all abnormalities, reported by Clients.

9.4. In the complaint, the Client should state his/her name and surname, address for correspondence, description of the abnormality and the date of its occurrence.
9.5. CINI SP. Z O.O. is obliged to refer to every complaint within 14 days, and if that wouldn’t be possible, to inform the Client immediately of when the complaint shall be dealt with.
X. Final provisions
10.1. Settlement of any disputes between CINI SP. Z O.O. and the Client, who is a consumer within the meaning of the Article 22 of the Polis
10.2. Settlement of any disputes arising between CINI Sp. z o.o. and the customer who is not a consumer within the meaning of art. 22 [1] of the Civil Code, is subject to the competent court for the seat of CINI SP. Z O.O..h Civil Code, is subject to the relevant courts in accordance with the relevant provisions of the Polish Code of Civil Procedure.
10.3. Matters not regulated herein shall be regulated by the Civil Code, the provisions of the Act on electronic services and other relevant provisions of Polish law.
10.4. The company CINI SP. Z O.O. reserves the right to change the regulations in these Terms and Conditions.
10.5. Regulations shall enter into force on the date of placing it in the services cini.com.pl and cini.mobi
